Re: Amendments to UK-US Extradition Act 2003
I am writing to you to express my anxiety and deepest concerns regarding the one-sided UK-US Extradition Treaty of 2003, whereby the U.S. can instantly seek the extradition of any British Citizen without providing any evidence. On Wednesday 21st July another British Citizen, Talha Ahsan, was arrested under this Treaty, despite having been found guilty of no crime in the UK.
In May 2006 the House of Commons voted against vital amendments to the Extradition Act 2003 tabled into to the Police and Justice Bill. This was overturned in the House of Lords in July 2006. The vote is due to return to the Commons soon after the Summer Recess.
As my elected representative, I would like to urge you to support the amendments of the Extradition Act 2003 to provide better safeguards. My concerns are:
- The Extradition Act 2003 allows a person to be extradited in respect of a crime alleged to have been committed substantially in the UK;
- This applies even if our prosecuting authorities have decided that there is insufficient evidence to prosecute or that prosecution is not in the public interest;
- The United States authorities are making extradition requests against UK citizens in respect of conduct allegedly committed in part in the UK, but the safeguard that the US should support its requests with evidence has been removed;
For those reasons, I would urge you to support the amendment of the Extradition Act 2003 to require the US to provide a prima facie case, and to allow the UK courts to block extradition where part of the alleged criminal activity occurred in the UK and trial in the requesting state would not be in the interests of justice. I therefore urge you to support the marshaled amendments to the Police and Justice Bill numbered: 186 – 191 inclusive.
Please could you ensure that you are available to vote in support of the amendments when this returns to the Commons and please also encourage your colleagues to do the same. I look forward to hearing from you regarding this urgent matter and would also like to meet you at your earliest opportunity to discuss this further
